The game seems to ignore Osmosis Shield's instant activate, thus allowing it to trigger the confusion effect and you losing a turn

Yes, but osmosis shield is the only instant-use ability that checks confusion, which is why I assume it's a bug.

To quote the wiki:
"Confused

The target is confused, acting randomly (with a certain percentage chance) and unable to perform complex actions. Talents with "instant" activation as well as items can still be used reliably. "
