Is there some special trick to Tirakai's Maul?

OK, so I got this item:

I first imbued it with a tier 1 yellow gem. It was great, giving me a Burst (radius 2) on crit for +12 light damage. When I had a crit, there'd be a blinding flash of light onscreen. Happened lots of times.

Then I imbued it with a tier 2 blue gem (Aquamarine). It's supposed to give me a Burst (radius 2) on crit for +24 lightning damage. But... it gives me nothing. After an hour of play, I've yet to see a single critical hit effect. It's like I downgraded the item when I upgraded the gem. The log never has it damaging more than one creature at a time.

I was going to post this in the Bugs forum, but I thought I'd check and see if I've misunderstood something.

Yeah, I have a bunch of tier 1 gems I could try, but I won't get that aquamarine back once I remove it. That cost money!

I also have Prox's Lucky Halfling Foot in my talent bar, and I've never seen it cooldown, not even once.

I'm starting to thnk all my special items hate me.

You get gems back when you switch the slot out in Tirakai's.

What?! I'm testing that out right now! I could have sworn I lost that earlier gem...

You probably just had another gem of that type and didn't notice it add to the stack. That happened to me a few times, but I've most certainly had my gems returned (was swapping to abuse stat boosts), and the item code definitely has an "add previous gem to inventory" bit... unless it's bugged. Tirakai's is sometimes persnickety.
