I didn't see anything in objects.lua granting that penalty...

Well my bad... I witnessed a decrease of 4% when using the Black Robe instead of the Chromatic Harness. What can affect spell crit? Luck? Seems that using the Water Silmaril decreases spell crit by 6% (-25 luck) and Chromatic Harness increases spell crit by 4% (+10 luck). In that case it's not a bug...

Yeah luck affects crit along many other things
